A Magistrates Court is set to rule today on whether former Nairobi Governor Mike Sonko will face trial in a Sh24 million graft case, based on an amended charge sheet.
This follows a decision by the High Court last year to reinstate the corruption case after ruling that Magistrate Douglas Ogoti had erred in acquitting Sonko and his co-accused.
Justice Nixon Sifuna, in overturning the acquittal, stated that the trial had relied on the original charge sheet instead of the amended one, which was a significant procedural mistake.
“The case will be retried before a different magistrate, who shall make a fresh ruling based on the evidence already on record to determine whether the accused have a case to answer,” Justice Sifuna directed.
Sonko, along with co-accused Anthony Ombok and ROG Security Ltd, had been acquitted in 2022 after Magistrate Ogoti ruled that the charge sheet presented by the Directorate of Public Prosecutions (DPP) was defective.
The reinstated case is being closely watched, as it represents a significant test for Kenya’s judiciary in handling high-profile corruption cases.
