Embattled Kericho Governor Eric Mutai has survived an impeachment after senators voted to terminate the hearings.
Mutai, through his lawyer, Katwa Kigen, had objected the impeachment case, saying the Kericho County Assembly did not meet the two-thirds threshold to impeach the governor.
Kigen argued that 31 MCAs voted to impeach his client against a threshold of 32. He said that two-thirds of 47 MCA gives 31.3, but the assembly should have rounded it off to 32 and not 31.
"The motion to impeach Kericho Governor Erick Mutai by impeachment did not meet the two-thirds threshold. The speaker of the County Assembly was wrong. It is only 31 out of the 47 who voted in support of the motion," Kigen said.
In the vote on Monday, October 14, 34 senators voted to terminate the impeachment case, concurring with Kigen over the two-thirds threshold.
