Former Deputy President Rigathi Gachagua has suffered a blow in his attempt to delay the hearing of the consolidated petitions seeking to overturn his impeachment.

Gachagua had made an application to stay the proceedings for 21 days to allow the Court of Appeal to determine his appeal on the constitutionality of the three-judge bench comprising Lady Justice Freda Mugambi, Eric Ogola and Anthony Mrima.

He had challenged the powers of Deputy Chief Justice Philomena Mwilu to appoint a three-judge bench to determine the said petitions.

The former DP had argued that the pending determination by the appellate court would have far-reaching implications on the proceedings before the three-judge bench.

However, in its ruling on Thursday, the bench rejected the request describing the application for an extension of time as a camouflage.

The hearing of the 40 petitions filed to challenge Gachagua’s ouster began today.
