Two senior officials from the National Youth Service (NYS) have filed separate lawsuits challenging their suspension over alleged involvement in a Sh2 billion public funds scandal.

Deputy Commandant General Nicholas Makhoha and Senior Superintendent David Mbogo have accused their employer of unlawfully suspending them on what they term as baseless allegations.

The duo was suspended following a move by the Ethics and Anti-Corruption Commission (EACC), which on May 2, 2025, filed an application in court seeking to investigate them over alleged accumulation of illicit wealth amounting to Sh510 million each.

The two have sued the NYS Council, Director General, Attorney General, and Public Service Cabinet Secretary Geoffrey Ruku, arguing that their constitutional rights have been grossly violated.

The officials claim that the EACC first published what they described as sensational accusations on its X (formerly Twitter) account, suggesting they had embezzled Sh2 billion, only for the figure to shift in court documents to Sh510 million.

In their court filings before High Court Judge Chacha Mwita, they argue that the disciplinary process against them is illegal and has caused reputational damage, economic loss, and psychological hardship.

Mbogo further claims that on May 19, 2025, CS Ruku directed NYS Commandant-General James Tembur to provide evidence of disciplinary action against unnamed officers suspected of conflict of interest and abuse of office.

According to court documents, Tembur acknowledged that he had not received formal communication on the matter but nonetheless sent Mbogo on compulsory leave.

The officials now want the High Court to intervene urgently, suspend the disciplinary process, and declare their suspension null and void.
