The High Court in Kenya has upheld Noordin Haji’s appointment as Director General of the National Intelligence Service. Noordin Haji had been challenged in his appointment as Director General of the National Intelligence Service. The High Court has now rejected the application to remove him from office.
Justice Lawrence Mugambi made the announcement on Thursday. The judge stated that there were no reasons to remove Noordin Haji from office. “The petition has no merit and is dismissed,” he said.
The petitioner had stated that Noordin Haji should not be allowed to take office because he has some pending cases in the High Court and Public Service Commission. However, the courts did not believe that these were grounds to remove Noordin Haji from office as Director General of the National Intelligence Service.
The judge stated that the courts should only interfere in such matters if there is proof that the appointment by the president was made through abuse of office. “We will not interfere unless there is clear evidence of presidential overreach,” he said.
Haji had stated that he had been appointed Director General of the National Intelligence Service by President William Ruto in 2023. Since then, there have been various petitions against his appointment to office. In 2024, he was challenged on grounds that he did not meet the requirements to be appointed to office because he had some pending cases related to his work as Director of Public Prosecutions. However, he was not suspended by the High Court.
