Deputy President Rigathi Gachagua’s request to bar Kisumu governor and lawyer James Orengo from involvement in his impeachment proceeding has been denied.
Gachagua, through his lawyer, Ndegwa Njiru, wanted Orengo kicked out of the proceedings, saying his current position as the governor contravenes Article 260 of the Constitution, which bars state officers from engaging in other gainful employment.
Njiru argued that allowing Orengo to participate in the trial would prejudice Gachagua’s defence.
However, ruling on the matter, Senate Speaker Amason Kingi dismissed Njiru’s argument.
Kingi said Gachagua’s defence team was unable to adduce evidence to prove the allegation of Orengo’s involvement in the case as gainful employment.
Notably, Orengo is representing the National Assembly in the impeachment case in the Senate.
