Lawyers representing Deputy President Rigathi Gachagua have dismissed the impeachment motion before the Senate, arguing that it fails to meet the required threshold.
Elisha Ongoya, one of Gachagua’s legal representatives, described the evidence presented by the motion’s mover as not only false and absurd but also embarrassing.
“Those of us who understand the nature of this motion can see through the desperate attempts at manipulation being made here,” Ongoya remarked.
He went on to claim, “The motion, as approved and presented by the National Assembly, will go down in constitutional history as the most embarrassing motion ever sanctioned by a parliamentary house in the Commonwealth.”
The impeachment motion, filed by Kibwezi West MP Mwengi Mutuse, lists 11 charges against Gachagua. Ongoya specifically addressed the allegation that Gachagua interfered with reforms at the Kenya Tea Development Agency (KTDA), arguing that no evidence, statement, affidavit, or correspondence from any KTDA official was provided to substantiate the claim.
“It’s merely a baseless accusation where the mover of the motion expects the National Assembly to take his word at face value, and unfortunately, they did,” Ongoya stated.
He also questioned how Gachagua could be accused of interfering in the renovation of his official residence, given that the National Assembly had already approved funds for the project.
