Court Seeks Verification of Businesswoman’s Medical Records in Property Damage Case

The Kibera Law Courts have directed police to verify medical documents presented by a businesswoman accused of malicious damage to property after she failed to take plea, citing illness.

The investigating officer was ordered to confirm whether the medical records submitted by the accused, Mary Waithira Gikonyo, were genuine before the next court appearance.

During the session, Hardy Police Station OCS Luke Muraya expressed concern over Waithira’s sudden illness claim, saying she had appeared healthy when she left police custody.

“I instructed my officers to escort Ms. Waithira to court, only to learn that she could not take plea because she was allegedly unwell,” Muraya told the court.

The OCS added that he was puzzled when the accused failed to show up again on the day set for plea-taking, supporting the prosecution’s call for the medical documents to be verified.

“Your Honour, I doubt the authenticity of the medical documents presented in court. They should be verified,” he said.

However, Waithira’s lawyer, John Swaka, defended his client, claiming her condition worsened after spending a night in custody, where she was reportedly denied bail.

He asked the court to grant a two-week adjournment, noting that the medical report had recommended seven days of rest.

The court declined to push the case forward by two weeks and instead directed that the accused appear for plea-taking on November 4, 2025. The magistrate warned that a warrant of arrest would be issued if she fails to attend.

According to the charge sheet, Waithira is accused of maliciously damaging property valued at KSh 325,000 on March 22, 2025, at Hardy along Kumbe Road in Lang’ata Sub-County.

The damaged items allegedly included a main gate, doors, window panes, and CCTV cameras belonging to Eric Munene.

The case will be mentioned on November 4, 2025, for plea-taking and presentation of the verification report on the medical documents.
