Court Bars Malala Arrest Over Kakamega Chaos, Orders Cooperation

The High Court has granted Cleophas Malala, Deputy Party Leader of the Democracy for Citizens Party (DCP), anticipatory bail of Ksh100,000 as investigations continue into the chaos that erupted during his homecoming event in Kakamega last Saturday.

In her ruling, Justice Diana Kavedza barred police from arresting or detaining Malala during the investigation but directed him to present himself at the Directorate of Criminal Investigations (DCI) headquarters within five days, and no later than June 3, 2025.

His legal team has also been instructed to accompany him for the scheduled interrogation.

However, the court declined to block the DCI or the Office of the Director of Public Prosecutions (DPP) from continuing with investigations or pressing charges if evidence supports prosecution.

“Should charges be preferred, Malala must be informed of the court where he is to appear for plea taking, and he shall not be arrested or detained,” the judge added.

She also ordered Malala to fully cooperate with investigators during the ongoing probe.

The ruling followed Malala’s application expressing fears of an imminent arrest that he claimed would violate his constitutional rights.

Chaos erupted during Malala’s homecoming event in Kakamega.

He alleged that the police intended to detain him on Friday, May 30, 2025, to keep him in custody over the long Madaraka Day weekend.

The homecoming event, which saw the presence of DCP leaders including Senators John Methu (Nyandarua) and Karungo Thang’wa (Kiambu), descended into chaos with teargas and clashes between police and party supporters as the delegation toured the region.
