Deputy President Rigathi Gachagua has suffered a major setback in his bid to stop the Senate from hearing his impeachment motion.
The DP had moved to court seeking orders to stop the Upper House from debating and voting on his impeachment, which is scheduled for October 16 and October 17.
Gachagua claimed in his petition that the National Assembly, where 282 MPs voted to impeach him, had violated his constitutional rights and the grounds for his impeachment were mere allegations.
However, on Tuesday, October 15, Milimani Law Court presiding Judge Chacha Mwita declined to stop the proceedings in the Senate as sought by Gachagua.
Mwita insisted that the Senate must be allowed to carry out its function as mandated by the constitution.
