A group of activists is calling for National Assembly Speaker Moses Wetang’ula to be jailed for six months for allegedly defying a court order that declared Azimio la Umoja as the rightful majority party in Parliament.

The activists have also filed a case at the Milimani Law Courts seeking to overturn Wetang’ula’s February 12, 2025, ruling, which upheld Kenya Kwanza as the majority side with 165 MPs, while Azimio remained in the minority with 154 MPs.

Additionally, they are pushing for the court to enforce its February 7, 2025, ruling, which barred Wetang’ula from performing any constitutional duties as Speaker if he remains the leader of the Ford Kenya party.

The ruling stipulated that a sitting Speaker cannot simultaneously hold a political party leadership position.

Through their lawyer Kibe Mungai, the activists argue that Wetang’ula’s ruling undermines the court’s decision and disrupts the established legal framework.

“The Speaker was obligated to respect the court’s ruling by recognizing Azimio as the majority, in line with the 2022 election results,” said Kibe.

According to the petition, Wetang’ula’s reliance on information from the Registrar of Political Parties to uphold Kenya Kwanza’s majority status was a deliberate disregard of the court order.

The activists further demand that all parliamentary sessions chaired by Wetang’ula be nullified until he relinquishes his Ford Kenya leadership position.

The legal battle now awaits a ruling, as the court is set to determine whether Wetang’ula’s decision will stand or be overturned in favor of Azimio.
