Third Attempt to Halt Gachagua's Impeachment Motion Fails in High Court

A third attempt to halt the impeachment motion against Deputy President Rigathi Gachagua has failed, as a three-judge bench of the Constitutional Division of the High Court declined to issue interim orders.

This decision follows previous unsuccessful attempts by former United Democratic Alliance (UDA) Secretary-General Cleophas Malalah and the civil society group Sheria Mtaani.

The petition was filed by Caroline Wambui Mwangi against the Senate and National Assembly, seeking to stop the impeachment process. Justice Lawrence Mugambi ordered that the application and petition be served by the close of business today.

“Responses to the Petition and Application must be filed and served within five days. Any rejoinder, if necessary, should be submitted within three days,” the court documents stated.

The case is scheduled for mention on October 9, 2024, for further directions.

The accusations against Gachagua include violations of Article 10 concerning the National Values and Principles of Governance, based on public statements that his critics argue are inciteful, reckless, inflammatory, and capable of provoking ethnic hatred and division.

Additionally, he faces allegations of breaching Articles 147, 148, 174, 186, and 189, which pertain to his conduct and responsibilities as the principal assistant to the President.

Furthermore, Deputy President Gachagua is accused of corruptly and unlawfully acquiring assets using taxpayers’ money.
