Speaker of the Senate Amason Kingi has issued a warning to senators, urging them to refrain from making public statements regarding the ongoing impeachment proceedings against Deputy President Rigathi Gachagua, currently under consideration in the National Assembly.

Kingi emphasized that, under Articles 145 and 150 of the Constitution, the Senate may eventually handle the matter for deliberation and determination.

He cautioned senators against criticizing or questioning the National Assembly’s proceedings, as it could potentially compromise the Senate’s impartial role if the case is referred to them.

“It shall be out of order for a senator to criticize or call to question the proceedings in the National Assembly,” Kingi stated. “I caution all honourable senators to desist from commenting on the proceedings.”

Kingi made these remarks following concerns raised by Senate Majority Leader Aaron Cheruiyot, who highlighted that some senators had already made public remarks on the impeachment issue in various forums, potentially undermining the impartiality of the Senate.

Kingi reiterated the importance of maintaining neutrality, as the Senate will act as a quasi-judicial body to hear and determine the case, should it proceed.

The Speaker further explained that comments made, whether written or spoken, could prejudice the outcome of the process in both the Senate and the National Assembly, warning senators to be cautious.

In addition to the case involving the Deputy President, Kingi also addressed the proposed impeachment of Kericho Governor Erick Mutai, noting that he would communicate further details when he receives formal communication from the Kericho County Assembly.

“Comments on the matter, whether written or spoken, may also prejudice the fair determination of the hearing regarding the Governor of Kericho County,” Kingi added.
