A divorce case that was brought to the Kiambu Chief Magistrate Court has turned dramatic and after Sarah Njoki Nyaga alias Sarah Mtalii made an effort to end her marriage with Simon Waithaka Kabu under Divorce Cause No. MCDC E086 of 2024. In filings made through Advocate Peter Mwenda Njagi, Sarah is now requesting leave of court to add one Maureen Kabu, as a co-respondent to the case. Maureen is said to be in a continued adulterous affair with the respondent, Simon Waithaka Kabu.
Maureen is said to be Simon Kabu’s biological child, born out of wedlock. The petitioner, however, argues that their current cohabitation is not paternal but intimate, with the two allegedly staying together in what was a former matrimonial home. Sarah maintains that she never met Maureen when she was married for 15 years and found out about her existence in 2022, shortly after she allegedly eloped with Simon. She also points out that no DNA test has been made available to confirm the father-daughter relationship, and it is hence suspected that the relationship could be romantic, even incestuous.
The petitioner also alleges that Simon Kabu has transferred matrimonial property to Maureen in an attempt to prevent the equitable division of property. She brings up the issue of the transfer of cars from Bonfire Adventures to Adequate Safaris Ltd, a company which is allegedly owned by Maureen. Documents provided include a printout of the couple from Facebook appearing comfortable with one another, statutory transfer of vehicles documents, and registration forms for companies.
Sarah has further recorded a long history of physical and emotional abuse, deception, and neglect within the marriage. The matter is currently pending before Honourable Jacqueline Karani, and speed is being sought in order to preserve the integrity of the proceedings and to prevent further dissipation of matrimonial assets.
