The Director of Public Prosecutions (DPP) has secured a life sentence against a 19-year-old schoolboy convicted of defiling a 9-year-old-boy at a primary school in Lamu.
Principal Magistrate Peter Wasike convicted Ali Hussein Kutu of defilement contrary to Section 8(1) as read with Section 8(2) of the Sexual Offences Act, following a full trial in which the prosecution called five witnesses.
The prosecution, led by Principal Prosecution Counsel Derrick Wawire, proved that Kutu intentionally and unlawfully sodomised the child on October 3 2025 at “A” Primary School in Langoni Location, Lamu Central Sub, County.
The court relied on the child’s testimony and medical evidence showing injuries in the anal region and a loose anal sphincter.
Magistrate Wasike rejected Kutu’s claim that he had been framed, saying the prosecution had proved the victim, the act and the perpetrator beyond reasonable doubt.
The court also considered a victim impact statement and pre, sentence report, which showed that the child suffered trauma and nightmares and was later transferred to another school for safety.
Although Kutu was a first-time offender with a positive school record, the court said his circumstances couldn’t alter the prescribed sentence. He was granted 14 days to appeal.
