The DPP is appealing the High Court decision that cleared Governor Natembeya, seeking to formally contest the ruling in the case related to the improper use of public funds.
The DPP filed a notice of appeal in which it seeks to have the High Court ruling overturned. The ruling was made by Bahati Mwamuye on March 4, that stopped state agencies from continuing investigations or charging the governor.
The court also stopped the Director of Criminal Investigations and the Ethics and Anti-Corruption Commission from continuing to act in the case. It also awarded the governor general damages amounting to KSh2.5 million.
The case was based on the alleged use of business interactions involving companies that had contracts with Trans Nzoia County. The prosecutor named Lyma Agro Science Limited, Maira Stores, and Easterly Winds Limited as the companies that were involved in business interactions with the governor.
The Director of Criminal Investigations alleges that the governor received money from people who were associated with the companies from January 2023 to April 2025. This was seen as a conflict of interest.
The governor was accused of having received KSh1.1 million indirectly from Mercy Chelangat, who was associated with Lyma Agro Science Limited and Maira Stores. It was also alleged that the governor received approximately KSh2.1 million from another company that was doing business in Trans Nzoia County.
The governor was accused of having committed two counts of conflict of interest in the Anti-Corruption and Economic Crimes Act.
With the appeal having been made, the DPP wants the court to look at the previous ruling and allow investigations and court action to go forward.
