Kenya has nominated Supreme Court Judge Njoki Ndung’u for election to the International Criminal Court (ICC), positioning her as the second Kenyan to potentially join the ICC bench after Judge Joyce Aluoch, who served from 2009 to 2018.
Justice Ndung’u joins six other candidates from around the world, including nominees from Ghana, Switzerland, Uganda, Tanzania, Colombia, and Japan. The ICC elections are scheduled for December 2026 during the 25th Assembly of State Parties in New York.
Justice Ndung’u has been listed in Category A under ICC rules, which includes judges with expertise in criminal law and procedure. According to her statement on the ICC website, she meets the necessary qualifications and has the relevant experience to serve at the international level, representing Kenya’s judicial expertise on a global platform.
Throughout her career, Justice Ndung’u has shaped Kenya’s legal landscape through landmark rulings and contributions to criminal justice reforms. She previously served as State Counsel and as a nominated Member of Parliament, where she advanced legislation such as the Sexual Offences Bill 2006 and amendments to employment and refugee laws. Since 2011, she has served on Kenya’s Supreme Court.
