Two men have been sentenced to death after they were convicted of four counts of robbery with violence in a case heard at the Moyale Law Courts in Marsabit County.
Nashon Ochieng Agutu and Jackson Okech Odhiambo were found guilty on all four counts following a full trial in which the prosecution presented evidence linking them to the April 2025 robbery.
Senior Principal Magistrate Willy Cheruiyot handed down the sentence after the prosecution, led by Prosecution Counsel Benard Leadi, called 13 witnesses in support of the case.
The charges arose from an incident on April 23, 2025, in Dabel area of Moyale Sub-County, where the two men, acting jointly with others, allegedly carried out an armed robbery targeting four victims.
“The charges arose from an incident on 23rd April 2025, in the Dabel area of Moyale Sub-County, Marsabit County, where the accused, acting jointly with others and armed with dangerous weapons, including guns, robbed Alinoor Mamo, Silas Kalunge, Linus Murithi Marinda and Bruno Thomas of cash, mobile phones and other personal belongings,”statement read.
According to the prosecution, the attackers were armed with dangerous weapons, including guns, and robbed Alinoor Mamo, Silas Kalunge, Linus Murithi Marinda and Bruno Thomas of cash, mobile phones and other personal belongings.
The victims were also assaulted during the attack and sustained injuries.
The court found that the evidence presented by the prosecution established the involvement of Agutu and Odhiambo in all four counts of robbery with violence, contrary to Section 295 as read with Section 296(2) of the Penal Code.
In passing sentence, Magistrate Cheruiyot considered the circumstances surrounding the robbery, the brutality of the attack and the use of lethal weapons.
“The court has taken into account the nature of the robbery attack, its brutality and the use of lethal weapons. A deterrent sentence is warranted. I sentence the two to death,” the magistrate ruled.
The two convicts have been granted 14 days within which to appeal against both their conviction and sentence.
The case highlights the prosecution of violent armed robbery offences, with the Office of the Director of Public Prosecutions saying the successful outcome followed the presentation of evidence linking the accused persons to the crimes.
