Naivasha MP Jayne Kihara was arrested today at her Maraigushu home, days after defying summons by the Directorate of Criminal Investigations (DCI) on allegations of incitement.

The DCI had invited her last week for allegedly making comments that could compromise a public officer, charges under Section 132 of the Penal Code.

But Kihara, in a statement to her lawyer, disobeyed the summons, citing the law quoted as being previously declared unconstitutional way back in 2017.

Her attorneys maintained that she could not serve a summons on the basis of a repealed law. Kihara also voiced her criticism of the government on X, calling the summons a political move to silence her for defying.

"The days when leaders were being intimidated by the criminal justice system are gone," she wrote

Her arrest has fueled worries about overreach by the legal system and escalating hostilities between security forces and critics of the government.
