Former Deputy President Rigathi Gachagua has moved his impeachment case to the Court of Appeal.

In his petition, Gachagua wants the appellant court to stop the hearing of two applications filed to set aside orders freezing the swearing-in of Kithure Kindiki as his successor.

The hearing of the two applications is scheduled for Tuesday, October 29 at the High Court in Nairobi before judges Eric Ogola, Freda Mugambi and Anthony Mrima.

"Pending hearing and determination of the intended appeal, this honourable court be pleased to issue an order staying the proceedings of the High Court in Nairobi High Court Constitutional petition No. E565 of 2024 as consolidated with Kerugoya E013 of 2024, E014 of 2024 and E015 of 2024, Rigathi Gachagua and eight others vs speaker national assembly and 12 others," Gachagua's application reads in part.

The former DP argued that the three aforementioned high court judges have openly shown their bias by declining to withdraw from the case.

As a result, he believes they will not serve him justice.
