The Director of Public Prosecutions (DPP) Renson Mulele has suffered a significant setback after the Milimani Chief Magistrate’s Court rejected his request to withdraw a KSh10 million fraud case involving Heritage Flowers Limited.
Principal Magistrate Paul Mutai, in a detailed ruling, declared that the withdrawal bid was made in bad faith, noting that the Office of the Director of Public Prosecutions (ODPP) failed to involve the complainant as stipulated under the Victims Protection Act. He emphasized that excluding the complainant amounted to a violation of their legal rights.
The case involves three accused persons charged with defrauding Heritage Flowers Limited over KSh10 million in 2021.
Magistrate Mutai further ruled that allowing the DPP’s application would result in a miscarriage of justice. He directed that the matter proceed to full hearing and be concluded on its merits, setting the next court date for 12th February 2026.
