The High Court of Kenya has suspended the Senate’s decision to impeach Meru Governor Kawira Mwangaza.

The ruling, issued on August 21, 2024, marks a crucial victory for the embattled governor, temporarily halting her removal from office that was upheld by the members of the senate on Tuesday evening.

Justice Bahati Mwamuye of the Milimani High Court delivered the orders following a petition filed by Governor Mwangaza.

The court document seen by Tukio.co.ke stated that the court’s decision came after reviewing the Certificate of Urgency, the Notice of Motion Application, and the Supporting Affidavit, all dated August 21, 2024.

The court also issued a conservatory order staying the implementation of the Senate’s resolution to remove Governor Mwangaza from office.

The court has restrained the Speaker of the Senate, Amason Kingi from publishing a notice of vacancy for the Governor’s position in the Kenya Gazette.

The court has set deadlines for the submission of responses, rejoinders, and written submissions from both parties.

The matter is scheduled for mention on September 17, 2024, to confirm compliance and set a date for highlighting of written submissions.
