A Nairobi court has ordered the immediate and unconditional release of Savannah Clinker proprietor Benson Sande Ndeta.

This follows a preceding High Court order stopping the businessman’s arrest, detention and prosecution.

Despite the High Court order, Ndeta spent the weekend in custody after Magistrate Gilbert Shikwe differed the bail ruling and directed the matter to be mentioned on January 30, 2025.

Appearing before Magistrate Shikwe, Ndeta was charged with eight counts, including conspiracy to commit a felony, obtaining execution of a security by false pretences and uttering false documents, to which he pleaded not guilty.

For instance, in one charge, he denied defrauding ABSA bank KSh 4.5 billion after purporting to act on behalf of Savannah Cement Limited.

Through his lawyer, Cecil Miller, Ndeta has filed an application to be released on cash bail pending the hearing and determination of the case.
