Justice Lawrence Mugambi has referred the case challenging the impeachment of Deputy President Rigathi Gachagua to Chief Justice Martha Koome, calling for the constitution of a bench to hear and determine the matter.
In his ruling on Friday morning, Justice Mugambi emphasized that the petition raises significant constitutional questions that require the attention of a multi-judge bench.
He noted that the complexities of the issues at hand necessitate a thorough judicial examination.
“The petition raises weighty constitutional issues that demand the empanelment of a bench to ensure a fair and comprehensive hearing,” stated Justice Mugambi.
The case stems from Gachagua’s recent impeachment from the national assembly, which has sparked national debate.
The Deputy President’s legal team filed the petition, seeking to challenge the legality and process of the impeachment motion passed by Parliament.
Chief Justice Koome is now expected to constitute a bench that will review the petition and issue a determination. This legal development will play a crucial role in shaping the next phase of the political and judicial battle over Gachagua’s impeachment.
