High Court Judge Chacha Mwita has directed Inspector General of Police Douglas Kanja and DCI boss Mohamed Amin to produce missing activist and blogger Ndiangui Kinyagia in court without fail.
In a ruling issued on Sunday, Justice Mwita said that if Kinyagia is not presented in court by Monday, both Kanja and Amin must appear in person to explain his continued disappearance or alternatively, to explain why he has been held for 10 days without making a court appearance.
On June 19, the activist shared a post on his X page, detailing the itinerary of the June 25 protests that included a plan to march to the State House and the declaration of a “new republic”
Kinyagia, who had been instrumental in organising the June 25 commemorative protests, went missing shortly before the protests and his whereabouts are yet to be determined.
He was last seen on June 21, according to Amnesty Kenya, when individuals believed to be DCI officers allegedly raided his home in Kinoo.
“He was taken in broad daylight. If he has committed a crime, let the law take its course,” Amnesty Kenya said in a statement, calling for his immediate release or arraignment.
Reportedly, his residence was surrounded by six to ten Subaru vehicles, and the last communication was with his mother around 1:00 pm that Saturday, June 21.
Since then, the security agencies, including the National Police Service and the DCI, have not responded to his whereabouts.
