Tamu Law Courts Resident Magistrate has sentenced a 45-year-old man to 30 years in prison for sexually assaulting a 14-year-old girl.

The accused, Dan Otieno Kaye, also known as Otia, committed the crime on multiple occasions between November 3, 2023, and February 2, 2024, in Koru Township, Muhoroni Sub-County, Kisumu County, Kenya.

After considering the testimonies of four prosecution witnesses, the court found that the accused acted with intent and unlawfully.

Magistrate Maureen N. Olonyi highlighted three key factors in her judgment: the victim’s age, evidence of penetration as outlined in Section 2(1) of the Sexual Offences Act, and the clear identification of the perpetrator.

Prosecution counsel Tabitha Shimoli presented strong evidence, including testimony from the minor, which confirmed the accused’s guilt beyond a reasonable doubt.

In her sentencing, Magistrate Olonyi emphasized that the accused had taken advantage of the minor’s vulnerability, misleading her into believing he intended to marry her.
