High Court Denies Second Request to Halt Gachagua's Impeachment Proceedings

The High Court has, for the second time, refused to issue orders to halt the impeachment proceedings against Deputy President Rigathi Gachagua.

The case was discussed on Monday before Justice Bahati Mwamuye, who instructed that the matter, filed by Cleopas Malalah, be presented to the Presiding Judge of the High Court, Chacha Mwita, for further instructions.

In a separate application, the National Assembly is seeking to consolidate all petitions challenging the impeachment process, arguing that the cases raise similar issues and should be joined for efficient and expedient court proceedings.

“Currently, there are thirteen (13) petitions before the High Court in Nairobi and other locations across the country, all contesting the impeachment of H.E. Rigathi Gachagua as Deputy President of the Republic of Kenya,” states the application.

On September 30, the court had already declined to issue orders preventing Parliament from processing the impeachment motion against Gachagua.

The motion, initiated by former UDA Secretary General Cleophas Malala, sought to stop both the National Assembly and the Senate from tabling, debating, or acting on any motion aimed at ousting the Deputy President.

Malala contended that both Houses do not meet the required two-thirds gender rule threshold, thereby violating constitutional provisions.
