The Director of Public Prosecutions has ordered the Directorate of Criminal Investigations to probe the reasons that led to the collapse of the multi-storey building in Eastleigh, Nairobi today following reports of injuries, property damage and missing persons.

On October 26, 2026 in a press statement, the ODPP said no enquiry file had been filed by the Nairobi City County Government for directions and consideration as regards the construction of the building.

The DPP based his decision to invoke Article 157(4) of the Constitution for a comprehensive investigation into the causes of the breakdown.

Investigators will consider if any activities or failures to act on the part of county officials, the private developer, contractors, or other of the experts working on the building’s design permitting inspection and construction played a role in the collapse.

When completed, the DCI will transmit the inquiry file to the ODPP for directions and review.

The office stated that prosecution will proceed when there will be enough evidence to prove that the person is guilty, irrespective of rank or status.

The DPP also extended sympathies to the injured victims and property owners affected by the explosion.

The ODPP warned developers, contractors, and construction professionals as well as public officers not to ignore building rules, safety standards and statutory approval processes.
requirements.

OFPP reiterated its commitment to accountability and the rule of law, saying it would work with investigative agencies to ensure cases warranting prosecution are handled in accordance with the Constitution and applicable laws.
