The Director of Public Prosecutions (DPP) has secured a life imprisonment sentence for a Kisumu man convicted of defiling and assaulting his 10-year-old daughter.
Maseno Magistrate’s Court, presided over by Hon. Lele Lucas Ikapolon, found the man guilty of defilement and cruelty to a child following a prosecution case led by counsel Victor Kipng’etich.
The offences occurred on diverse dates between January 2026 and May 18, 2026, in Kisumu Sub-County, according to evidence presented in court.
The prosecution called six witnesses, including a clinical officer whose medical evidence confirmed injuries consistent with sexual abuse and physical assault. The child had sustained an injury to her right eye and blunt trauma to her lower abdomen.
Court proceedings heard that on May 18, the man allegedly returned home drunk, threatened the child to remain silent, defiled her, beat her and burnt her clothes.
The minor subsequently escaped and sought refuge at a neighbour’s home. She later reported the incident to her teachers, who alerted the children’s officer and police. She was taken to hospital for examination and treatment.
In his ruling, Magistrate Ikapolon said the prosecution had proved both defilement, contrary to Section 8(1) as read with Section 8(2) of the Sexual Offences Act, and cruelty to a child under Section 152(1)(a) of the Children Act, 2022, beyond reasonable doubt.
The convict was sentenced to life imprisonment and has 14 days to appeal the decision.
