The High Court has dismissed a petition by, among others, the Law Society of Kenya, which was seeking orders to compel the government to produce missing Kenyans allegedly abducted by police officers.
In a ruling on Thursday, Justice Bahati Mwamuye stated that there was no evidence that the supposed abducted individuals were in police custody.
Mwamuye noted that six out of eight allegedly abducted persons had already re-appeared from places other than police custody.
The judge said while the remaining two, Stephen Mbisi Kavingo and Kelvin Muthoni, were still missing, there was no evidence that they were held in police custody to warrant him to issue orders for the state to produce them.
While dismissing the petition, Mwamuye said LSK failed to prove that police were holding Muthoni and Mbisi who were allegedly abducted by suspected officers.
