DPP Under Fire for Delayed Prosecution of Police Officers in Baby Pendo Case

The Director of Public Prosecutions (DPP) is facing strong criticism for failing to prosecute eleven senior police officers linked to the brutal killing of Baby Pendo during the 2017 post-election violence.

Appearing before Justice Margaret Muigai, the victim’s lawyer, Willis Otieno, lamented the delay, noting that seven years had passed without justice being served.

He reminded the court that two judges—Justice Kanyi Kimondo and Lady Justice Lilian Mutende—had previously ruled that the officers should face criminal charges.

Otieno dismissed the DPP’s argument that prosecution could not proceed due to the absence of one suspect, Mohammed Mbaa. He insisted that the remaining ten officers should be charged immediately, with the charge sheet amended later if Mbaa is located.

“The victim’s dignity has been denied, and justice remains unserved,” Otieno stated, further opposing the DPP’s request for an adjournment, which he termed unnecessary and unjustified.

Justice Muigai is set to rule on the DPP’s request for more time on January 30, 2025.
