The Ethics and Anti-Corruption Commission (EACC) has recovered public land worth KSh51 million in Nyali, Mombasa County following a settlement of a 17-year-long dispute.

The property, MN/I/2411, registered as belonging to Kenya Civil Aviation Authority is 0. 514 acres in size. As part of the ADR settlement, concluded on September 21 2026 the owner, Omar Tahir was supposed to hand back the property to the public.

The recovery follows civil proceedings instituted by the Commission in 2009 at the Mombasa Environment and Land Court, ELC Case No. 177 of 2009, involving the EACC, Zakayo Kipkemboi Cheruiyot, Omar Tahir, and Sammy Mwaita.

According to EACC investigations, the land was irregularly and unlawfully allocated in the year 2000 by the then Commissioner of Lands Sammy Mwaita to former Kuresoi Constituency MP Zakayo Kipkemboi Cheruiyot. Zakayo later transferred the land to Tahir.

The ADR settlement has allowed the property to be returned to the public for its original purpose after several years of legal wrangling, the Commission said.

EACC has called upon persons having any illegal or irregularly obtained public assets to voluntarily surrender the same so that they can be retrieved and avoid long and costly legal battles.
