The Director of Public Prosecutions (DPP) has filed 17 new charges against 15 officers attached to the Directorate of Criminal Investigations (DCI) and the National Intelligence Service (NIS) over the alleged 2022 kidnapping of two Indian nationals and their Kenyan driver.
The suspects — Peter Gachiku, James Tanki, Joseph Mbugua, David Kipsoi, Joseph Mbaya, John Kamau, Hillary Kipchumba, Stephen Matunda, Simon Gikonyo, Paul Muriithi, Bonface Mtulia, Elikana Mugendi, Fredrick Kamau, John Mavhari and Michael Bett — have been summoned to appear before the Kahawa Law Courts on September 7, 2026, for plea-taking.
The summons were issued by the Kahawa Law Courts, with the suspects expected to appear before Senior Principal Magistrate Njeri Thuku.
Among the charges they are expected to face is kidnapping with intent to murder, contrary to Section 258 of the Penal Code, as well as conspiracy to commit a felony, contrary to Section 393 of the Penal Code.
The DPP has also charged the suspects with offences relating to cruel, inhuman or degrading treatment under the National Intelligence Service Act.
Additional allegations include forgery, subjecting individuals to cruel, inhuman and degrading treatment, and cooperating in the execution of such treatment.
Alleged 2022 Kidnapping
According to the prosecution, the case relates to events of July 22, 2022, in Nairobi County, when the suspects allegedly travelled in four motor vehicles alongside other individuals whose identities have not yet been disclosed.
The prosecution alleges that the group trailed and intercepted a vehicle carrying Mohammed Zaid Sami Kidwai and Zulfiqar Ahmed Khan, both Indian nationals, and their Kenyan driver, Nicodemus Mwania Mwange.
The latest charges follow an earlier set of proceedings against the officers.
The DPP said the new charges were filed after the High Court terminated the earlier murder proceedings, allowing prosecutors to institute fresh charges based on the evidence available.
The prosecution team handling the matter comprises Victor Owiti, Betty Rubia, Bridgit Atieno, Anthony Musyoka, James Machirah, Kennedy Amwayi and Harrison Kiarie.
The 15 suspects are expected to formally respond to the charges when they appear before the Kahawa Law Courts in September.
