Former party leader Irungu Nyakera has called on President Ruto’s administration to immediately restore Deputy President Rigathi Gachagua’s security, staff, and privileges after the Court of Appeal declared the impeachment bench that sat on Gachagua’s removal “unlawfully constituted.”
In a statement issued on Monday, Nyakera emphasized that the Court’s ruling not only found Deputy Chief Justice Philomena Mwilu’s October 18, 2024 appointments of the three-judge panel unconstitutional but also ordered that the matter be reheard by a properly constituted bench.
“he Court of Appeal has ruled that the bench which heard Rigathi Gachagua’s impeachment case was unlawfully constituted hence declaring Deputy Chief Justice Mwilu’s appointment of the judges unconstitutional. The matter must now be reheard by a properly constituted bench, as directed by the Court,” Nyakera stated.
Nyakera warned that any attempt to recognise Kithure Kindiki as Deputy President would violate both the Constitution and the active court order.
“Any continued recognition of Kithure Kindiki as Deputy President flies in the face of both the Constitution and an active court order.,” he added.
He urged the Office of the President and the Judiciary Service Commission to act swiftly in constituting a lawful bench to ensure Gachagua’s petition is heard in accordance with constitutional requirements.
