New Twist in Gachagua Impeachment Saga

Former Deputy President Rigathi Gachagua has moved to the Court of Appeal in a fresh attempt to overturn the High Court decision that upheld his impeachment from office.

The appeal filed on Tuesday comes barely weeks after a three-judge bench ruled that his removal from office was constitutional, dealing a major blow to his efforts to reclaim the position he lost in October 2024.

In court papers filed at the Court of Appeal, Gachagua argues that the High Court erred in law by upholding the impeachment despite finding that his constitutional rights had been violated during the process.

The former Deputy President has consistently maintained that the judgment was contradictory, insisting that an impeachment process found to have violated his rights could not be allowed to stand.

The High Court had awarded Gachagua KSh50 million in compensation for the violation of his rights but declined to overturn Parliament’s decision to remove him from office.

The ruling paved the way for Kithure Kindiki to continue serving as Deputy President.

Gachagua’s latest move now sets the stage for another legal showdown that could shape not only his political future but also the interpretation of impeachment laws in Kenya.

The former Deputy President has in recent months intensified his criticism of President William Ruto’s administration while positioning himself as a key opposition figure ahead of the 2027 General Election.

His allies have repeatedly argued that the impeachment process was politically motivated, claims that have been rejected by Kenya Kwanza leaders.

With the matter now headed to the Court of Appeal, the legal battle that began in Parliament nearly two years ago appears far from over.

The outcome is expected to be closely watched by both supporters and opponents, given its potential impact on future impeachment proceedings involving senior State officers.
