Former Deputy President Rigathi Gachagua appeared in court accompanied by his family and political allies as his legal team challenged his removal from office in October 2024.
Through his lawyers, Gachagua appealed to nullify both his impeachment as Deputy President which he argued all was null and void since the proceedings contravened the provisions of the Constitution and lacked due process of law.
He also remarked on the retrospective speed with which the motion of no confidence was dealt with, intimating that the result was decided before the meeting took place.
They further raised questions about the fairness of Senate Speaker Amason Kingi and National Assembly Speaker Moses Wetang’ula whom they accused of actively campaigning for their motions even before due process had begun.
Justices Eric Ogola, Anthony Mrima and Dr. Freda Mugambi were told that the Gachagua’s ouster was politically motivated and his lawyers even alleged that the members of the National Assembly and the Senate were paid bribe money.
Gachagua is now demanding compensation and for Kindiki’s appointment as Deputy President to be declared illegal and unconstitutional. The case will continues with the submissions on 7th of May.
