The Ethics and Anti-Corruption Commission (EACC) has recovered public land valued at KSh40 million, including three government houses, in Milimani, Kakamega Town, near Kakamega State Lodge.
The property comprises approximately 1. 05 acres, is owned by the State Department for Housing and Urban Development.
In a statement released on Tuesday, EACC said that the land was recovered after court proceedings. They indicated that the land was registered and allocated illegally, identified as Kakamega Municipality Block III/212.
On 22nd September 2026, Justice A. Nyukuri directed a consent order that Macdonald Lijoodi Makaka to surrender his rights and interests in the property to the government.
The court further ordered the Chief Land Registrar to cancel the entries on the lease that had been issued to the Makaka.
EACC investigations revealed that the parcel of land was being set aside and reserved for government housing and not for allocation to private individuals. However, a letter of allotment was issued to Makaka on December 10, 1992, and a registered lease issued to him on June 4, 1993.
Despite the contention over assignment, the three houses continued to be on the Government Building Register.
The commission said it was seeking to have the titles and registration of the land be cancelled in the government’s name to preserve the property for public use.
EACC urged Kenyans to conduct due diligence before buying land, including finding out about the ownership of the land and confirming if the land is meant for public use.
