High Court Extends Orders Protecting Jimi Wanjigi from Arrest

The High Court has extended the orders preventing the police from arresting businessman Jimi Wanjigi until September 19.

However, Justice Bahati Mwamuye clarified that he could not issue an order halting the registration of any charges against Wanjigi, as the current application only addresses issues of arrest, not prosecution.

Wanjigi’s lawyer, Willis Otieno, requested the extension, stating, “Several developments have occurred that we need to bring to the court’s attention, which will require amending the application. We are seeking this order to prevent any prejudice.”

The Director of Public Prosecutions (DPP) opposed the request, arguing, “Otieno is asking for relief that has not been requested in the application. They are attempting to preempt our opposition, which will detail how they have failed to demonstrate any threat to the petitioner’s rights. We oppose an order that would prevent us from filing charges.”

Following the arguments, the judge granted Wanjigi seven days to file and serve an amended petition.

The case is scheduled for mention on September 19.
