Court Clears Nominated IEBC Chair, Commissioners to Be Sworn and Assume Office

The High Court in Nairobi has given the green light for the swearing-in of a new chairperson and commissioners of the Independent Electoral and Boundaries Commission (IEBC).

This is after a three-judge bench comprising justices Roselyne Aburili, John Chigiti, and Bahati Mwamuye dismissed a petition that challenged the selection and nomination of Erustus Ethekon Edung as the electoral agency’s chair and six commissioners.

The six include Ann Njeri Nderitu, Moses Alutalala Mukhwana, Mary Karen Sorobit, Hassan Noor Hassan, Francis Odhiambo Aduol, and Fahima Araphat Abdallah.

The bench ruled that the petition filed by Kelvin Roy Omondi and Boniface Mwangi lacked merit.

However, the judges quashed a Gazette Notice dated June 10, 2025, by President William Ruto appointing the seven, saying it was published in contravention of the conservatory orders dated and issued by the Court on 29th May, 2025 which prohibited, inter alia, the gazettement and appointment of the nominees pending the hearing and determination of the petition.

The bench directed a new notice to be issued to regularise their appointment. President Ruto has since issued a new Gazette Notice reappointing the seven in adherence to the directive.

They are now set to be sworn in before Chief Justice Martha Koome.
