NYC Aspirants Seek Conditional Resumption of Elections, Demand Audit of Election Spending

An interested party in the ongoing legal dispute surrounding the National Youth Council (NYC) elections has asked the court to allow the electoral process to resume under strict conditions, while separately calling for an independent audit of public funds allocated to the exercise.

Wambura Keter Brian, chairman of the NYC Aspirants Forum, made the appeal during an interview in Kiambu town, saying he had asked the court to allow the elections to proceed subject to compliance with issues raised in the main petition within 30 days.

In a Notice of Motion dated September 26, 2026, Brian argued that the issues raised in the main petition should not indefinitely delay the electoral process, urging the court to consider measures that would safeguard democracy, fairness and the interests of all aspirants.

He maintained that the concerns raised in the petition could be addressed through strict compliance requirements without bringing the entire election process to a standstill.

“Our intention is not to derail the electoral process but to ensure that it is conducted in a transparent, fair and accountable manner. The outstanding issues can be addressed through strict compliance within a reasonable timeframe, allowing young people to exercise their democratic right to elect their leaders,” Brian said.

Separately, Brian has petitioned Auditor-General Nancy Gathungu to conduct an independent audit of public funds allocated, released and spent in preparation for and implementation of the 2026 NYC elections.

In a letter dated October 29, 2026, he sought a comprehensive financial review to establish how taxpayers’ money committed to the electoral process had been utilised.

“Public funds allocated to the elections must be accounted for. Young people and taxpayers deserve to know how the money was budgeted, released and spent. An independent audit will help establish accountability and restore confidence in the electoral process,” he added.

Among the issues he wants examined are the total budget approved for the elections, funds disbursed, expenditure commitments and actual spending.

The proposed audit would also scrutinise expenditure on youth sensitisation, civic education and voter awareness campaigns, including the geographical areas covered and activities undertaken.

Other areas flagged for investigation include procurement of election materials, ICT infrastructure, consultancy services, training of election officials, transportation, accommodation, security and administrative expenses.

Brian has also asked the Auditor-General to examine expenditure incurred following the suspension or postponement of the elections, including additional financial commitments arising from changes to the electoral programme.

He wants the audit to establish whether the expenditure was properly authorised, supported by relevant documentation and delivered value for money.

The two interventions come amid ongoing court proceedings in the case involving Emelda Kwamboka and the State Law Office over the NYC electoral process.

Brian argued that allowing the elections to proceed under clear judicial safeguards, alongside an independent financial audit, would protect the interests of young people while strengthening transparency and public confidence in the council’s leadership transition.
