LSK Demands Compliance After Court Orders Cabinet Reshuffle

The Law Society of Kenya (LSK) has urged the Executive to comply fully with a High Court ruling directing the reconstitution of the Cabinet within 120 days for failing to meet the constitutional two-thirds gender principle.

In a statement, LSK President Charles Kanjama described the judgment as a landmark decision that reaffirms the supremacy of the Constitution in the exercise of executive authority.

“The High Court has delivered a landmark judgment ordering the reconstitution of the Cabinet within 120 days for failing to meet the mandatory two-thirds gender principle,” Kanjama said.

He noted that the ruling reinforces the constitutional requirement under Article 27 of the Constitution of Kenya, which guarantees equality and freedom from discrimination, emphasizing that inclusivity is a fundamental principle of governance rather than a matter of political discretion.

Kanjama said the Law Society insists on “full and immediate executive compliance” with the court’s directive to ensure the Cabinet conforms to constitutional standards.

The judgment places fresh pressure on the Executive to review the composition of the Cabinet and ensure that appointments comply with the gender representation requirements set out in the Constitution. The ruling is expected to reignite debate over gender equity in public appointments and adherence to constitutional provisions governing leadership and representation.
