Former Kiambu Governor Ferdinand Waititu has been ordered back to custody after the High Court cancelled his bond in the KSh588.7 million graft case.

Justice Rose Ougo of the Milimani Anti-Corruption High Court issued the orders on Wednesday, October 14, 2026, directing Waititu and his co-convict, Luka Mwangi Wahinya, to be remanded at Nairobi Remand Prison.

The decision marks a fresh setback for the former governor, who had been out of prison on bond as he pursued an appeal against his conviction and sentence.

Waititu was convicted in February 2025 over the irregular award of a road construction tender in Kiambu County. He was sentenced to 12 years in prison or ordered to pay a fine of approximately KSh53.5 million.

The case centred on a KSh588 million tender awarded to Testimony Enterprises Limited for road works in several parts of Kiambu County during the 2017/2018 financial year.

Prosecutors presented evidence that Waititu received money linked to the tender through his business interests, leading to his conviction on corruption-related charges.

His wife, Susan Wangari Ndung’u, was also convicted in the case and sentenced to one year in prison or a fine of KSh500,000.

Waititu has challenged his conviction and sentence in court, seeking to have the decision overturned on appeal.

In July 2025, the High Court granted him bond of KSh53 million pending the hearing of his appeal, allowing him to leave prison.

The latest ruling, however, cancels the bond terms previously granted to Waititu and Wahinya and directs both men to remain in custody.

The court proceedings are part of the ongoing legal battle arising from the Kiambu roads tender scandal, which resulted in convictions and sentences for several individuals linked to the procurement process.
