Gachagua Impeachment: Court Mandates New Public Participation Across All Constituencies

The High Court in Kerugoya has ordered the National Assembly to conduct additional public participation exercises in every constituency regarding the impeachment of Deputy President Rigathi Gachagua.

This directive follows an urgent petition filed by Kirinyaga Woman Representative Jane Njeri Maina.

Previously, the National Assembly had only organized public participation events in 47 centers across all counties.

Justice Richard Mwongo noted that while the public hearing scheduled for today (October 4) can proceed as an initial stage, the respondents in the case are required to organize similar public hearings at the constituency level.

This will allow constituents to engage in the impeachment process and provide their input.

In issuing the order, the judge referenced Supreme Court rulings that emphasize the importance of meaningful public participation. He highlighted that such participation must be genuine and involve reasonable notice to the public.

The matter, deemed urgent, was brought to the court by Kirinyaga Woman Rep Jane Njeri Maina, who has filed suit against the Senate, National Assembly, and others.

The judge has instructed her to serve her papers to the respondents in preparation for a mention date next Friday, when further directions will be given.
