Blow to Gachagua as Court Declines to Stop His Impeachment

Deputy President Rigathi Gachagua has suffered a major blow in his bid to block MPs from tabling and debating his impeachment motion.

Former UDA secretary general Cleophas Malala had moved to court seeking orders to block the National Assembly and the Senate members from acting upon the motion.

In the court papers seen by TUKIO.co.ke, Malala argued that the National Assembly and the Senate are unconstitutional in terms of their composition as they do not meet the constitutional requirements regarding the ‘no more than two-thirds gender rule’ set out under Article 27(8) and Article 81(b) of the 2010 Constitution.

However, Milimani High Court’s Justice Bahati Mwamuye declined to issue interim orders, stopping both Houses from discussing the motion as demanded by Malala.

The case will be mentioned on October 10.

Notably, Gachagua’s impeachment motion is expected to be tabled in the National Assembly on Tuesday, October 1, by MP Didmus Barasa.
