Blow to Gachagua as Court Allows Swearing in Of Kindiki

The High Court has lifted conservatory orders that had blocked the swearing-in of deputy president nominee Kithure Kindiki.

Petitioners David Munyi and Peter Gichobi had moved to court to block Kindiki’s swearing-in until the hearing of cases against Rigathi Gachagua’s impeachment.

However, the three-judge bench Eric Ogola, Justice Anthony Mrima and Fredah Mugambi ruled to discharge the conservatory orders.

The judges argued that it is in the interest of the public that the office of the deputy president cannot remain vacant.

“The applications for conservatory orders are hereby disallowed. The conservatory orders issued on October 18, 2024 in Kerugoya High Court are hereby discharged and/or set aside. We grant leave for appeal. Typed proceedings and certified copies of this ruling to be availed to parties at cost. We will mention this matter on November 7, 2024 at 2pm in the open court,” Justice Ogola ruled.
